Bystander intervention is defined as safe and positive options that may be carried out by an individual or individuals to prevent harm or intervene when there is a risk of dating violence, domestic violence, sexual assault or stalking.

Students, faculty and staff who violate this Policy may face discipline up to and including expulsion or termination.

The applicable procedures will depend on whether the alleged offender is a student, faculty or staff member.

This amendment requires colleges to include the crimes of dating violence, domestic violence, and stalking in their annual security report, provide additional rights, services and information to victims of sexual assault, dating violence, domestic violence and stalking, as well as offer primary and ongoing prevention and awareness programming and campaigns.

Under Board Policy and Administrative Regulation 3540: Sexual and Other Assaults On Campus, any sexual assault or physical abuse, including, but not limited to, rape, domestic violence, dating violence, sexual assault or stalking as defined by California law, whether committed by an employee, student, or member of the public, occurring on District property, in connection with all the academic, educational, extracurricular, athletic, and other programs of the District, whether those programs take place in the District’s facilities or at another location, or on an off-campus site or facility maintained by the District, or on grounds or facilities maintained by a student organization In California, consent means “affirmative consent”.

Title VII of the Civil Rights Act of 1964 (Title VII) prohibits discrimination based on race, color, sex, religion, or national origin, and the Americans with Disabilities Act (ADA) prohibits discrimination on the basis of disability.[1] Because these federal EEO laws do not prohibit discrimination against applicants or employees who experience domestic or dating violence, sexual assault, or stalking as such,[2] potential employment discrimination and retaliation against these individuals may be overlooked.
